ACCESS TO AND USE OF THE WEBSITE

The Website is intended for attendees of the congress 16 World Meeting on Pharmaceutics, Biopharmaceutics and Pharmaceutical Technology (PBP) (hereinafter, the “User”) to facilitate accommodation bookings at BCO CONGRESOS partner hotels.

The User declares that they are of legal age (i.e. over 18 years old) and have the legal capacity to purchase the services offered through the Website in accordance with this Legal Notice and Terms and Conditions of Use (hereinafter, the “General Conditions”), which they fully understand and accept. In the event of a booking made by a minor, BCO CONGRESOS shall under no circumstances be held liable, and the minor, parents or legal guardians shall assume any resulting costs.

Use of the Website constitutes an agreement between the User and BCO CONGRESOS, whereby the User expressly accepts full and unreserved adherence to each and every one of the General Conditions published by BCO CONGRESOS at the exact moment the User accesses this portal, especially those relating to the limitation of liability of both BCO CONGRESOS and any hotel provider. Therefore, the User must carefully read the General Conditions each time they intend to use the Website, as they may have been modified since the last access. If you don't accept these Conditions, please refrain from using the website and its content.

Access to the Website is free of charge and does not require prior subscription or registration. However, some services may be subject to prior registration or purchase of a product or service published on the Website.

Upon registering on our Website, the User will have a username (their email address) and a password chosen by them, which will subsequently be communicated by email.

The User is responsible for safeguarding and keeping the password confidential, preventing unauthorized third parties from accessing it. The User agrees to be responsible for the financial consequences arising from any use of the Website through the User’s password, as well as any use of the User’s password by third parties.

Likewise, the User declares that all information provided for access to and use of the Website is true, complete and accurate, and undertakes to keep it updated in future use of the services offered on the Website.

LIABILITY AND LIMITATIONS

To the maximum extent permitted by applicable law, BCO CONGRESOS does not guarantee and shall not be held liable for:

BCO CONGRESOS makes every effort to avoid errors in Website content. BCO CONGRESOS shall not be responsible for consequences arising from errors in content provided by third parties when BCO CONGRESOS was unaware of such errors.

USER OBLIGATIONS

The User undertakes to make appropriate use of the services and contents offered by BCO CONGRESOS and not to use them for:

Carrying out unlawful activities or criminal acts contrary to good faith, morality, public order, accepted practices and/or violating intellectual or industrial property regulations or any other applicable legal provisions.

Disseminating racist, xenophobic, pornographic or terrorist-apologist content or content violating human rights.

Introducing or spreading data programs (viruses or harmful software) capable of damaging BCO CONGRESOS systems, suppliers or third-party internet users.

Transmitting usernames and passwords to unauthorized third parties. If passwords become known to unauthorized users, the User undertakes to immediately inform BCO CONGRESOS, which reserves the right to modify them to protect the service.

Making available to other users, sending by email or transmitting any content that, under applicable law or contractual obligations, the User is not authorized to transmit (such as privileged information, protected industrial or intellectual property information or confidential information).

Sending unsolicited advertising, promotional material, junk mail, chain letters, pyramid schemes or any other form of solicitation, except in areas specifically intended for such purposes.

Reproducing, duplicating, copying, selling, reselling or exploiting for commercial purposes any section of the service, use of the service or access to it.

COMMUNICATIONS

The User must contact BCO CONGRESOS through the email address indicated above. In any case, and unless otherwise expressly required by law, communications from BCO CONGRESOS to the User shall preferably be carried out electronically using the contact details provided. The User expressly accepts the use of email as a valid procedure for exchanging information and communications with and/or from BCO CONGRESOS.

PURCHASE OF PRODUCTS AND SERVICES THROUGH THE WEBSITE
6.1 APPLICABLE CONDITIONS AND AVAILABLE PRODUCTS

These general terms and conditions govern the purchase of any tourism product marketed by BCO CONGRESOS through the Website and, specifically, hotel accommodations and complementary accommodation services.

Through the Website, the User has access to information regarding different hotel providers. The User may make bookings at BCO CONGRESOS partner hotels in order to attend the congress.

Contracting services shall be governed by (i) these general conditions, (ii) the specific conditions established by the hotel provider, and (iii) the applicable regulations.

The User agrees to accept and comply with the terms and conditions established by any provider chosen by the User, including but not limited to payment of any applicable amounts and compliance with any rules and restrictions regarding availability of rates, products or services. If there are special rules or restrictions affecting specific rates, products or services selected by the User, such rules or restrictions shall be displayed before proceeding with the pre-booking.

BCO CONGRESOS acts as an intermediary in the purchase process between the User and the final accommodation service providers and shall not be responsible for the final provision of the service marketed through the Website. Hotel providers shall be responsible to the User for compliance with applicable regulations and the sales conditions of each contracted product or service.

All bookings made through our Website are automatically recorded and stored in our system. Proof thereof is the booking confirmation page, which automatically displays the booking reference number and all related details. Additionally, the system automatically sends the booking information and supporting travel documents to the client’s email address. A contact telephone number is always provided for any doubts or inquiries.

The contract for acquisition of services through the Website shall be formalized in Spanish.

6.2 BOOKING PROCESS

The booking process shall be carried out electronically through the Website following these steps:

1st: Hotel and Stay Selection: The User must select the hotel where they wish to stay, reviewing the description, availability, prices, specific conditions and any other relevant information. The User must also indicate the desired stay dates and number of guests.

2nd: Identification: The User must complete the form with identification and contact details.

3rd: Confirmation of Details: Before proceeding with payment, the User must verify purchase details (hotel, dates, number of guests, total price) and provide payment details.

4th: Payment: The User may pay for contracted products and services through the following payment methods: credit card

5th: Booking Confirmation: Once payment is confirmed, the User will receive a confirmation email containing all details of the contracted accommodation, as well as vouchers or documents required for use. The User is responsible for checking receipt of this email and, if applicable, the spam folder.

6th: Acceptance of the General Conditions: Acceptance of the privacy policy and applicable general and specific conditions is mandatory for the purchase of any product or service.

Bookings where final clients are not identified by name shall not be considered valid, and services requested therein shall only be provided to those designated in the original booking. Test bookings shall be treated as cancellations and subject to the applicable cancellation policy.

If, for any reason, there is an error between the stay price shown by the booking system and the actual applicable price, the latter shall prevail. In such case, the User may choose between maintaining the booking by paying the correct price or cancelling it without cancellation charges applying.

6.3 PRICE

Accommodation prices are those indicated on the Website at the time of purchase. All prices are shown in euros (€) and include Value Added Tax (VAT) and any other applicable taxes, unless expressly stated otherwise. BCO CONGRESOS reserves the right to modify prices at any time, although the applicable price for each booking shall be the one published on the Website at the time of booking confirmation by the User.

The price does not include tourist taxes applicable in many destinations. Such taxes, where applicable, must be paid directly by the final client to the hotel establishment upon check-in.

6.4 MODIFICATION AND CANCELLATION OF SERVICES

After formalizing the booking, the User must review its contents in order to identify any material errors in the entered data.

Any modification or cancellation of contracted services must be requested by the User via email to congresos@bcocongresos.com . BCO CONGRESOS must expressly confirm the modification and/or cancellation by email. Otherwise, the modification and/or cancellation shall not be valid and, if the User fails to appear at the beginning of the service, the cancellation policy indicated at the time of booking shall apply.

For each modification and/or cancellation request, BCO CONGRESOS shall inform the User of any applicable charges according to the conditions indicated at the time of booking.

RIGHT OF WITHDRAWAL

This is the User’s right to terminate a contract in certain cases without justification or penalty.

Pursuant to article 103(l) of Royal Legislative Decree 1/2007, the right of withdrawal shall not apply to contracts relating to accommodation services for purposes other than residential use, transport of goods, vehicle rental, food services or leisure-related services, where the contract provides for a specific execution date or period.

Accordingly, the User shall not have the right to withdraw from the contract once the booking has been made and purchase confirmed, without prejudice to the modification and cancellation conditions set out in section 6.4 of these General Conditions.

If the User expresses their intention to cancel any services contracted through this Website, the cancellation conditions indicated at the time of contracting shall apply.

INFORMATION REGARDING THE USE OF PERSONAL DATA

The information or personal data provided by you shall be processed in accordance with the Privacy and Cookies Policy. By using this Website, you consent to the processing of such information and data and declare that all information or data provided is truthful and accurate.

INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

All Website contents, including but not limited to texts, photographs, graphics, images, icons, technology, software, links and other audiovisual or sound content, as well as graphic design and source codes, are the intellectual property of BCO CONGRESOS or third parties. No exploitation rights recognized under current intellectual property legislation are transferred to the User except those strictly necessary for use of the Website.
Modification, copying, reproduction, public communication, transformation or distribution, in any form, of all or part of the Website contents for public or commercial purposes is prohibited without prior written authorization from BCO CONGRESOS or the relevant rights holder.

If any clause is declared wholly or partially null or ineffective, such nullity or ineffectiveness shall affect only that clause or the affected part thereof, while the remaining provisions shall remain fully valid.

The validity period of these General Conditions therefore coincides with the duration of their publication until wholly or partially modified, at which point the updated texts shall become effective.

COMPLAINTS, CLAIMS AND INFORMATION REQUESTS

BCO CONGRESOS shall respond to received complaints as soon as possible and, in any case, within a maximum period of one month from submission.

BCO CONGRESOS shall provide the User with an identifying reference and written acknowledgment via email or SMS so that the User has evidence of their complaint or claim.

BCO CONGRESOS has official complaint/claim forms available upon request through the Customer Service Department.

APPLICABLE LAW AND JURISDICTION

These General Conditions and any relationship arising from or related to their acceptance shall be governed exclusively by applicable Spanish law and the competent jurisdiction.

However, where regulations allow voluntary submission to a specific jurisdiction, the parties expressly waive any other jurisdiction that may correspond to them and agree to submit exclusively to the courts of Palma de Mallorca, which shall have exclusive jurisdiction to hear and resolve any dispute arising from or related to these General Conditions.
